Terms of Service
Effective: June 12, 2026
These Terms of Service (these "Terms") set out the conditions for using the app "SnapDrop" and related web pages (together, the "Service") provided by Dream Noark LLC ("we," "us," or "our"). By using the Service, you are deemed to have agreed to these Terms.
Article 1 (Definitions)
- Operator user: a user who uses the operator mode of the Service to capture photos, issue QR codes, and the like (such as event operators and performers).
- Fan user: a user who uses the fan mode of the Service or the web pages to receive and collect SnapDrops.
- SnapDrop: digital content captured or generated through the Service, such as photos, videos, doodle timelapses, and voice messages.
- Trading card: a digital card configured by an operator user and provided by random draw when a SnapDrop is received.
Article 2 (Accounts)
- You can start using the Service without registering (with an anonymous account). To save purchases, use the Service across multiple devices, or restore data, you must register an account with an email address and password.
- An operator user may share a single account across multiple devices within a group (such as a venue or team). The operator user is responsible for managing the shared password.
- If you delete the app without registering an account, you will permanently lose access to the data in your anonymous account (trading cards, balances, and so on). SnapDrops stored only on your device are lost when the app is deleted.
- If unauthorized access, impersonation, or similar conduct is discovered, we may suspend the account.
Article 3 (Billing)
- All billing on the Service is processed as in-app purchases through the App Store / Google Play.
- Capture tickets (consumable): purchased tickets are managed on our servers. Because tickets cannot be restored through a store's "Restore Purchases," account registration is required to purchase them. Used tickets are not eligible for refunds.
- Subscriptions (operator plans / cloud backup): these renew automatically. To cancel, use the settings in each store (iOS: Settings > Apple ID > Subscriptions / Android: Google Play > Payments & subscriptions) at least 24 hours before the renewal date.
- Cloud backup (Keepsafe pack): for 90 days after cancellation, data can only be restored, after which it is permanently deleted. Deleted data cannot be recovered.
- Refunds are subject to each store's refund policy. We cannot issue refunds individually. If a refund is issued, the corresponding tickets and rewards will be revoked.
Article 4 (Rights and Responsibilities for Captured Content)
- When capturing content, the operator user is responsible for obtaining consent from the subjects regarding the capture and the use within the Service (including provision to fan users).
- Copyright and other rights in a SnapDrop belong to the operator user who captured it or to the rightful holder. We handle the content only to the extent necessary for hosting (delivery and storage).
- Fan users may enjoy the SnapDrops they receive for personal use. Without the permission of the subject and the photographer, you may not use them commercially, modify them, redistribute them to third parties, or publish them on social media or elsewhere (except where the operator user has separately granted permission).
- SnapDrops on our servers are automatically deleted 5 days after capture. We are not responsible for SnapDrops that are not received within that period.
Article 5 (Trading Cards, Gacha, and Trading)
- Trading cards are provided through a random draw (gacha) when a SnapDrop is received. The drop rates are displayed within the app.
- Digital items such as trading cards and tickets have no monetary value and cannot be exchanged for cash or refunded.
- Trading cards may be traded only through the in-app trading feature. Buying or selling outside the app, or exchanging items for cash or goods (real-money trading), is prohibited.
- A trade is completed upon confirmation by both parties and cannot be reversed once completed.
Article 6 (Prohibited Conduct)
You must not engage in any of the following:
- Conduct that violates laws or public order and morals.
- Capturing or distributing images without the subject's consent, or infringing the portrait rights, privacy, copyright, or other rights of others.
- Buying or selling SnapDrops or trading cards outside the app (real-money trading).
- Unauthorized access, reverse engineering, cheating, or attempting to tamper with draw results or balances.
- Improperly obtaining content by unauthorized copying, resale, or transfer of QR codes to third parties.
- Harassment, impersonation, or nuisance toward other users.
- Creating, sending, or distributing inappropriate content that is obscene, violent, discriminatory, illegal, or otherwise offensive to others (including images of subjects without their consent).
- Interfering with the operation of the Service.
Article 7 (User-Generated Content and Handling of Misuse)
- On the Service, content captured or created by users (SnapDrops, doodles, voice, and so on) is shared with other users. The user who created such content bears primary responsibility for its contents.
- We have zero tolerance for inappropriate content and abusive behavior. Users can report inappropriate content or users through the in-app "Report" feature, and can cut off interaction with a specific user through the "Block" feature.
- Prohibited content: Sexual or obscene expression, nudity, and explicitly sexual content, as well as violent, discriminatory, or illegal content, are prohibited. In particular, content that sexually depicts children (child sexual abuse material) is strictly prohibited; if discovered, it will be removed immediately and, where applicable, reported to law enforcement in accordance with applicable law.
- We may perform automated safety checks and manual review of uploaded images, and we may block or remove content that may violate these Terms.
- When we receive a report, we aim to review it within 24 hours and take appropriate measures, including removing content that violates these Terms and suspending or removing the offending user's account.
- Where we deem it necessary, we may remove content or suspend a user's access without prior notice.
Article 8 (Changes to and Suspension of the Service)
We may change, suspend, or terminate all or part of the Service without notice due to maintenance, failures, or other unavoidable circumstances. If we terminate the Service, we will provide advance notice within a reasonable period.
Article 9 (Disclaimers)
- We do not warrant that the Service is free from defects in fact or in law.
- If delivery of a SnapDrop is not completed due to network conditions, device status, or similar factors, we will endeavor to re-deliver it but do not guarantee the integrity of the data.
- We are not a party to, and bear no responsibility for, disputes arising between operator users and fan users, or between users and third parties (including those relating to portrait rights or the operation of events such as photo sessions).
- If we are liable for damages, the amount is limited to the total amount that the relevant user paid us in the most recent six months (except in cases of our willful misconduct or gross negligence).
Article 10 (Changes to These Terms)
We may change these Terms as necessary. If there are material changes, we will provide advance notice within the app or on this page. If you use the Service after a change, you are deemed to have agreed to the revised Terms.
Article 11 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. In the event of a dispute relating to the Service, the Tokyo District Court shall be the court of exclusive agreed jurisdiction for the first instance.
